Background

Mark Robert Heston (Rob) and I were high school classmates and we were on the same athletics team. We were both long distance runners and cross-country bike racers.

First settlement:

Rather than press criminal and civil charges for being drugged and raped, a settlement was reached in which Marrmann Inc invested $400 million for 20% interest in Rainbow, my husband Rob’s company. Subsequently, Rainbow acquired controlling interest in Structural Inc, for $280 million.

During the time that attorneys were preparing the documents needed for Marrmann Inc to complete the purchase of Rainbow stock, Dewhite Marrmann profusely apologized to Rob about the rape incident. Dewhite Marrmann insisted on paying for all of our medical and counseling expenses, including both sets of parents and our siblings.

Dewhite continued; “Rob I had your patent disclosures analyzed by a team of material scientists, professional engineers, environmental impact specialists, and production cost experts. Their report highly commends your carbon fiber and graphene inventions to reinforce structures that are stronger than steel and lighter than aluminum at a fraction of the cost and environmental impact of steel structures. And my business advisors are very favorable about your IPO plan and subsequent licensing of your carbon technologies to Rainbow Structurals.”

Rob replied; “Thank you Dewhite for your product research. Please send me a copy.”

Dewhite continued; “Rob now that we are on the same side would you and Laura please consider making at least one Double Rider sales video. Please let me know when you and Laura can take a test ride before you decide. If you say yes or no, I will understand.”

Never underestimate a spurned wife:

About a month after Marrmann Inc’s $400 million investment in Rainbow was completed, Dewhite Marrmann, Robert and Laura Heston, Rainbow Structural Inc, were served as Defendants in a civil lawsuit for damages. The Plaintiff is Mary Louese Marrmann, soon to be the third ex-wife of Dewhite Marrmann.
Mary Louese Marrmann (Mary Lou) claims some of her damages arose from each and every Defendant’s failure to secure her marital estate’s approval for Marrmann Inc’s $400 million investment settlement.

Another of Mary Lou’s pleadings for relief states that on information and belief, Laura Leigh Heston drugged herself, dressed provocatively, and acted like she was sexually receptive, to cause Dewhite to commit adultery thus injuring Plaintiff.

Another of Mary Lou’s many pleadings for relief provides for Court Ordered Voidance of the limits imposed by the Prenuptial Agreement that she had with Dewhite Marrmann.

Dewhite Marrmann is represented by the same big law firm that represented Marrmann Inc in the $400 million investment. The remaining Defendants are represented by the same much smaller law firm Smithmeyer, Hamm, and Greely that represented Rainbow, Rob and me, along with Structural Inc in the $400 million investment.

Mary Lou is represented by a law firm known for contingency-fee representation of vehicle accident victims and malpractice by medical professionals and hospitals.

Our Defendants’ attorneys answered and counter-claimed for damages, court costs, and attorney’s fees. And we moved for an IN CAMARA hearing for requiring all present and future litigation including evidence to be IN CAMARA, in other words, to be secret by Court Order. Defendants also moved for Summary Judgment and to Waive a Jury trial.

In their opposition to Summary Judgment and to Waive a Jury trial, Plaintiff submitted the testimony of an Expert Regarding Rape stating in part that, “In many cases a wife wrongfully claims that she was raped to deflect her husband from suspecting that her adultery was actually willing infidelity.”

The Court granted Defendants’ motion for IN CAMARA litigation, denied Summary Judgment and to Waive a Jury trial.

High costs of Plaintiff’s discovery including expert opinions:

Our Defendants’ attorneys agreed to cause the Plaintiff’s attorneys the pain of spending a lot of money on discovery issues including answering lengthy interrogatories, for video depositions, and costly opposition to our evidence including:
1) A report from a highly qualified Voice Recording Expert who analyzed Laura and Rob’s cell phone Rape Recording. This expert verified their recordings as un-modified, and non-AI evidence. He identified the voice patterns and characteristics of each person and designated Dewhite Marrman, Dale Bottoms, and Laura Leigh Heston for each of their respective portions of the Rape Recording.
2) A report from Dr. Alice Winshaw, a highly qualified MD, who is also Laura Heston’s gynecologist. She noted bruises on my arms, neck, around my vulva and an anal tear that she believes occurred during the double penetration event as described in the voice evidence of sexual vaginal and rectal intercourse. She also reported and appended laboratory findings of ketamine in my blood, urine, and tissue samples that she took from me. Dr. Winshaw also referenced and appended copies of photographs including close-ups of the anal tear and the audio recordings. She also referenced and included her notes about treating a difficult anal infection with antibiotic prescriptions. Dr. Winshaw also noted seamen along with testosterone, ketamine and Viagra in the fluid taken from condoms used by Dewhite Marrmann and Dale Bottoms.
3) A report from a highly qualified Expert Regarding Rape who interviewed me, examined the evidence and submitted a First Summary including a strong Opinion countering each point of the Plaintiff’s Expert’s Opinion.
4) A report from a highly qualified Medical Psychology Expert who interviewed me, examined the evidence, and submitted a First Summary report including a strong Opinion about Laura Heston’s behavior as a ketamine drugging victim and each of the rapist’s motives and actions with footnote references about how ketamine sometimes produces rage and violent actions by men.
5) A report from a highly qualified DNA Expert who examined the hair, seamen, skin and vomit evidence, and submitted a First Summary report of the chain of evidence custody and a strong Opinion about DNA source identifications of Dewhite Marrman, Dale Bottoms, and Laura Leigh Heston.
In less than five weeks all five Expert Opinion reports had been sent to our attorneys for review and requests for comments by me, Dewhite Marrman, and Dale Bottoms.

Upon reviewing the five expert opinion reports, Dewhite Marrman unexpectedly offered to provide an affidavit for purposes of this litigation admitting that he and Dale Bottoms raped me. He would only sign the affidavit on the condition that no further civil or criminal actions would be taken against him, Dale Bottoms, or Glenna Jean Gormley.

Notices of Deposition were served for various persons including Mary Louese Marrmann, Glenna Jean Gormley (Dale’s key employee and test rider who witnessed my conditional NDA), James R. Pedderson (a technician who recorded the sensor data from my Double-Rider test) and Janice Adams, another one of Dale Bottoms’ technicians.

The next day, Mary Lou’s lawyers said they would advise Mary Lou to drop her lawsuit if our side would drop our counter suit. Defendants’ attorneys met with our group and we all agreed to drop our Counter Suit if Mary Lou would drop her Lawsuit and for both sides to pay their own expenses and attorney fees.

On the following day, an agreement was reached for both sides to drop their lawsuits and for each side to pay their own expenses and attorney fees.

Defendants met again and signed the agreement documents. Surprisingly, Dewhite Marrmann said; “Now that Mary Lou’s lawyers are gone I am willing to go beyond the limitations of our Prenuptial Agreement and set up a $250,000 Trust and allow Mary Lou to keep driving the Porsche and live in our home for 5 years if she pays the car and home utilities, insurance, taxes, maintenance, and car fuel out of the $250,000 Trust.
Dewhite continued: “Afterall, Mary Lou took good care of me for 10 years. Maybe we will go to counseling together and reconcile sometime during the next five years.”

What were you thinking?

Rob has been so concerned about my health, particularly my mental health, and we discussed everything.
